Family reunification and special protection: Turin Court recognises the right

The Court of Turin, with judgment of 27 October 2025 (Judge Alessandria), has upheld the appeal represented by lawyers Elena Garelli and Alberto Pasquero of Studio Legale Oltre, affirming the right to family reunification for holders of residence permits for special protection. The decision annulled the decree of the Turin Prefecture which had denied reunification, ordering the issue of clearance for the applicant’s wife and four minor children.

The judgment represents a significant precedent in the case law landscape following the reform introduced by the Flow Decree (d.l. no. 145/2024), which had amended Article 28 of the Consolidated Immigration Act. The Court held that a systematic interpretation in conformity with European Directive 2003/86/EC and Article 8 ECHR requires recognition of the right to family unity also for holders of special protection, highlighting the unreasonableness of any exclusion.
